Why Your Support Matters
Bill 7, the More Beds, Better Care Act, targets a vulnerable group of hospital patients designated as “alternative level of care” (ALC) and who are awaiting placement into a long-term care home (LTCH). Bill 7 forces these patients, the majority of whom are elderly and living with serious chronic conditions, into LTCHs they have not chosen, which may be far from family or in facilities with substandard records of care.
Under Bill 7, clinicians can label patients as “no longer needing hospital care” without clear criteria, and applications for LTCHs can be commenced and homes chosen, without the consent of the patient or their substitute decision-maker. If a bed is offered into a home, including one they have not chosen, they must leave hospital, or they will be charged a $400 per day fee. These beds are chosen by Ontario Health atHome placement co-ordinators and may be up to 70 km away in Southern Ontario or 150 km or further in the North (depending upon availability). This coercive relocation disregards their fundamental right to give informed consent, often leading to physical and psychological harm and, for some, hastening the end of life.
This legislation violates Section 7 of the Canadian Charter of Rights and Freedoms, which guarantees the right to life, liberty, and security of the person. By forcing these moves, it strips seniors of autonomy, dignity, and equality, infringing upon their rights under Section 15.
