What Is This Case About?
This class action alleges that Crown Crest Leasing Ltd., Peoples Trust Company, and affiliated companies and individuals engaged in unlawful practices relating to HVAC lease agreements. The case centers on the registration of security interests (liens) on homeowners’ properties without proper disclosure—allegedly in violation of consumer protection laws.
The lawsuits seek compensation for consumers across Canada (except Quebec) who entered into HVAC lease agreements between July 17, 2013 and January 15, 2025, through Crown Crest Capital Management Corp., Crown Crest Financial Corp., Crown Crest Funding Corp., HCSI Home Comfort Inc., HCSI Home Comfort 2 Inc., Simply Green Home Services Inc., Simply Green Home Services Corp., Utilebill Home Services Inc., Crown Crest Capital Trust, Simply Green Retail Services Inc., Crown Crest Billing Corp., Simply Green Home Services (BC) Inc., Simply Green Home Services (AB) Inc., Simply Green Home Services (SK) Inc., and Simply Green Home Services (MB) Inc. (collectively referred to as the “Settling Defendants”).
Settlement Now Approved
The Court has approved a comprehensive national settlement of the class actions against the Settling Defendants. This does not constitute an admission of wrongdoing, but it provides a range of financial and legal benefits for eligible class members.
Who Is Eligible?
You may be a class member if:
- You are a homeowner in Canada (excluding Quebec), and
- You entered into a lease agreement—directly or indirectly—for HVAC or related equipment with Crown Crest Capital Management Corp., Crown Crest Financial Corp., Crown Crest Funding Corp., HCSI Home Comfort Inc., HCSI Home Comfort 2 Inc., Simply Green Home Services Inc., Simply Green Home Services Corp., Utilebill Home Services Inc., Crown Crest Capital Trust, Simply Green Retail Services Inc., Crown Crest Billing Corp., Simply Green Home Services (BC) Inc., Simply Green Home Services (AB) Inc., Simply Green Home Services (SK) Inc., and Simply Green Home Services (MB) Inc. between July 17, 2013 and January 15, 2025
How to Make a Claim
If you paid a buyout or termination fee, you may be eligible for cash compensation. If you still have an active lease, you may be able to apply for lease cancellation and equipment gifting.
